Do You Pay Taxes When Buying and Selling Property for Hong Kong Property?

(Part 1) Understanding Your Intentions
In Hong Kong, whether you need to pay taxes on property transactions depends on whether those transactions constitute “business” activities.
The tax authorities gather information about taxpayers’ motives, financial arrangements, and the duration of property ownership to make their determinations.
You might wonder: while bank statements and transaction documents are only numbers, how do you prove your “intention”?
In reality, personal behavior and circumstances often reveal underlying motives, which can be crucial in the outcome of your case.
Take the case number D21/22 as an example. The appellant bought and sold 17 properties from 2007/08 to 2011/12. The tax assessor deemed these transactions are “business in nature”, thus subjecting the profits to business tax. The appellant argued that some of the properties were for her family residence, but her appeal was ultimately rejected.
- Loophole 1: Economic Situation Can’t Be Faked!
In fact, during the relevant tax years, the appellant was unemployed, her husband was bankrupt, and she had borrowed from siblings to pay the down payment. This reflects that neither she nor her spouse had the financial capacity to cover mortgage payments. Trying to pay a mortgage without an income is simply an “impossible mission.”
Loophole 2: “Flipping” as the Primary Goal
The appellant admitted during hearings that she only briefly lived in the properties to facilitate buyer viewings, aiming to sell at a higher price as soon as possible. This indicates that from the start, she viewed the properties as commodities for profit, not as a long-term home for her family. Even though her family did stay there briefly, this did not negate her intention to selling the property for profit when the property is bought. - Tax Authorities Rely on Facts
This analysis reveals how tax authorities assess individual economic situations and behaviors to understand your motives for buying and selling assets.
